The Envision Michigan Story Competition
OFFICIAL RULES
NO PURCHASE NECESSARY.
1. Eligibility: The Envision Michigan Story Competition (the "Contest") is open only to legal residents of Michigan who are at least fourteen (14) years old at the time of entry and who did not purchase any equipment for purposes of entering the Contest. Employees of The Center for Michigan, Inc., Public Sector Consultants, ePrize, LLC, and any of their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations. Void outside of Michigan and where prohibited by law.
2. Sponsor: The Center for Michigan, Inc., 4100 North Dixboro Road, Ann Arbor, MI 48105. Administrator: ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069.
3. Agreement to Official Rules: By participating in the Contest, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrator, which are final and binding in all matters related to the Contest. Whether an entrant receives a prize is contingent upon fulfilling all requirements set forth herein.
4. Timing: The Contest begins on October 2, 2007 at 12:00 a.m. Eastern Time ("ET") and ends on April 30, 2008 at 11:59 p.m. ET (the "Contest Period"). The Contest consists of two (2) phases as set forth in the chart below.
Submission starts at at 12:00 a.m. ET on October 2, 2007 and ends at 11:59 p.m. ET on March 31, 2008. Judjing starts at 12:00 a.m. ET on April 1, 2008 and ends at 11:59 p.m. on April 30, 2008.
Sponsor’s computer is the official time-keeping device for the Contest.
5. How to Enter:
a. Online Video, Photo and Essay Submission: During the Submission Phase, visit http://www.thecenterformichigan.net (the "Contest Blog") and follow the links and instructions to submit one (1) video, one (1) photo with caption or one (1) text essay describing your Michigan: what you love about Michigan, what you dislike about Michigan and/or your vision for Michigan’s future (the "Submission"). You will receive one (1) entry into the Contest.
b. Mail-In Photo and Essay Submission: To enter a Submission (photo or text essay, videos entered via this method will not be accepted) via mail, hand print your name, address, day and evening phone numbers, email address (if any) and age on a 3" x 5" piece of paper, enclose it with your Submission and mail it with proper postage to: The Center for Michigan,Envision Michigan Story Competition, c/o The Center for Michigan, 4100 North Dixboro Road, Ann Arbor, MI 48105. You will receive one (1) entry into the Contest. Limit: One (1) Submission per envelope. All mail-in entries must be postmarked by March 31, 2008 and received by April 7, 2008. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.
For All Methods of Entry: By completing the registration and entering your Submission, you agree that your Submission conforms to the Submission Guidelines and Content Restrictions as defined below (collectively, the "Guidelines and Restrictions") and that Sponsor, in its sole discretion, may remove and/or disqualify your Submission from the Contest if it believes, in its sole discretion, that your Submissions fails to conform to the Guidelines and Restrictions.
Submission Guidelines:
Videos must be three (3) minutes in length or less and linked directly to the Contest Blog;
Photos must be linked directly to the Contest Blog;
Photos must not be altered or manipulated, except for cropping, red-eye removal and adjustment for color and brightness;
Photo captions must be three hundred fifty (350) words or less;
Text essays must be seven hundred (700) words or less; and
Submissions cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means previously.
Content Restrictions:
Submissions must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
Submissions must not contain brand names or trademarks;
Submissions must not contain images or artwork not created by entrant;
Submissions must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
Submissions must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; and
Submissions must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Submission is created.
All Submissions will become the exclusive property of Sponsor, and none will be acknowledged or returned. Sponsor shall have the right to edit, adapt and publish any or all of the Submissions, and may use them in any media without attribution or compensation to the entrant, his/her successors or assigns, or any other entity. ENTERING A SUBMISSION IN THIS CONTEST CONSTITUTES ENTRANT’S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANFERENCE TO SPONSOR ANY AND ALL RIGHT, TITLE AND INTEREST IN THE SUBMISSION INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS. Sponsor is not responsible for lost, late, incomplete, invalid, un-intelligible, misdirected or postage-due (if entering by mail) Submissions, which are disqualified. Limit: Each participant may submit up to three (3) Submissions during the Contest Period.
6. Winner Determination: Winners will be determined via the process set forth below.
(a) For Grand, First, Second, Third, Fourth and Fifth Prizes: During the Judging Phase, qualified judges (selected by Sponsor in its sole discretion) (the "Judges") will select and rank, from all eligible Submissions received during the Submission Phase, potential winners based on the following criteria ("Judging Criteria"):
Originality (25%)
Creativity (25%)
Passion (25%)
Vision for Michigan’s Future (25%)
(b) For Sixth Prizes: On the Monday following the conclusion of each calendar week during the Submission Phase, the Judges will select, from all eligible Submissions received during that applicable week, one (1) Sixth Prize winner based on an application of the Judging Criteria.
For All Prizes: In the case of a tie between two (2) or more Submissions for any prize, the Submission with the highest Quality score will be the winner of the applicable prize.
7. Winner Requirements: Potential winners will be notified by mail, email or phone on or around May 15, 2008 (if for Grand, First, Second, Third, Fourth or Fifth Prize) or on or around the Wednesday following the calendar week he/she entered the Contest (if for Sixth Prize). Each potential Grand, First, Second and Third Prize winner (parent/legal guardian if winner is a minor) will be required to execute and return to Administrator, within ten (10) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release ("Affidavit") in order to claim his/her prize. Each potential Grand, First and Second Prize winner (or winner’s child, subject to Sponsor approval) may be required to show proof of a valid student identification from a Michigan public university (or community college if for Second Prize) in order to claim his/her prize. If a potential winner cannot be contacted, fails to execute and return the Affidavit within the required time period (if applicable), or fails to provide proof of student identification (if applicable), he/she forfeits the prize. Failure to comply with the above requirements, return of prize notification or prize as undeliverable or disqualification of a potential winner for any reason will result in forfeiture of prize and the prize will remain un-awarded. Acceptance of any prize shall constitute and signify winner’s agreement and consent that Sponsor may use the winner’s name, city, state, likeness, photo, Submission and/or prize information in connection with the Contest, worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law. Prizes will be fulfilled within eight (8) to ten (10) weeks after the conclusion of the Contest.
8. Prizes: ONE (1) GRAND PRIZE: A $12,000 scholarship to a Michigan public university. Approximate retail value ("ARV"): $12,000.
ONE (1) FIRST PRIZE: A $5,000 scholarship to a Michigan public university. ARV: $5,000.
FOUR (4) SECOND PRIZES: A $2,337.50 scholarship to a Michigan public university or community college. ARV: $2,337.50.
FOUR (4) THIRD PRIZES: A $1,000 travel voucher for a vacation to one (1) of the following destinations (destination to be determined by Sponsor in its sole discretion): Boyne Mountain Resort, Crystal Mountain Resort, the Grand Hotel on Mackinac Island or Thunder Bay Resort. Vacation packages include three (3) days, two (2) nights accommodations (single room, double occupancy) at a hotel of Sponsor’s choice at the applicable destination. ARV: $1,000.
ONE (1) FOURTH PRIZE: A $500 vacation package to metro-Detroit, including two (2) days, one (1) night accommodations (single room, double occupancy) at a hotel of Sponsor’s choice. ARV: $500.
ONE (1) FIFTH PRIZE: A $500 vacation package to The Betsie Bay Inn in Frankfort, Michigan, including two (2) days, two (2) nights accommodations (single room, double occupancy), and a restaurant voucher. Blackout dates apply. ARV: $500.
TWENTY-SIX (26) SIXTH PRIZES (one (1) awarded per week): A $50 Meijer gift card. Terms and conditions of gift card apply. ARV: $50.
For Scholarship Prizes: Scholarship to be deposited with the appropriate office managing winner’s (or winner’s child, subject to Sponsor approval) tuition accounts of the Michigan public university winner (or winner’s child, subject to Sponsor approval) attends and applied towards that person’s tuition at that school. Scholarship is non-transferable and not redeemable for cash. If winner (or winner’s child) does not attend or plan on attending a Michigan public university at time of confirmation, Sponsor, in its sole discretion, may chose to not award the prize.
For Vacation Packages: Vacation package to be awarded in the form of prize vouchers. Terms and conditions of vouchers apply. Package must be booked at least twenty-one (21) days prior to departure. Package subject to availability and blackout dates. All expenses and incidental costs not expressly stated in the package description above, including but not limited to, transportation, meals, incidentals, personal charges at lodging, taxes or other expenses are the responsibility solely of winner. Unless child/ward of winner, companion(s) must be eighteen (18) years of age or older as of the date of departure. Companion(s) must execute liability/publicity releases prior to issuance of vacation package documents. Restrictions, conditions and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen vouchers or certificates.
For All Prizes: Limit: One (1) prize per person. Prizes are non-transferable and no substitution will be made unless Sponsor, in its sole discretion, determines otherwise. Sponsor reserves the right to substitute a prize or prize component for one of equal or greater value should it become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.
9. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, Public Sector Consultants, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. Sponsor is not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor and Administrator not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Contest.
12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
13. Entrant's Personal Information: Information collected from entrant is subject to ePrize, LLC’s Privacy Policy (http://www.eprize.com/privacy/privacypolicy.html) and Sponsor’s Privacy Policy (http://www.thecenterformichigan.net/privacy/).
14. Winner List: For the winner list, send an email with Subject Line: The Envision Michigan Story Competition, Winner List Request, to info@thecenterformichigan.net. Requests must be received by September 15, 2008.
